Hours of Service Regulations: Truck Accident Lawyer in Indianapolis

Truck Accidents and Violations of Hours of Service Regulations

The Hours of Service Regulations were established by the US Department of Transportation to reduce the numbers of accidents caused by fatigued truck drivers. The number of hours that a truck driver can be behind the wheel are regulated, so that he or she does not become fatigued. If you were involved in a car accident with a trucker, my firm can seek out the evidence that could expose any violation of the Hours of Service Regulations. I'm attorney Marc Sedwick, and I am extremely familiar with hours of service regulations, and how to establish that a violation was the underlying cause of a serious injury accident. I am ready to discuss your case immediately, and you can trust me to work hard to get your case resolved. I have been listed in Rising Stars℠ by Super Lawyers® for the past two years, so you can be confident in my firm.

Long-haul truckers have a tough job. They spend hours in their trucks and their shifts are long. The government has mandated specific on-duty/off-duty time regulations that truckers must abide by in order to make sure they are capable of driving safely. One of these rules is that truckers cannot be on duty for more than 14 hours after taking at least 10 hours off duty, and during those 14 hour shifts, the trucker can only drive for 11 hours. Once a trucker has reached the end of a 14-hour shift, he or she cannot drive again until 10 hours of rest are completed off-duty. There are ways to prove that a trucker violated these or other regulations. Truck drivers must keep accurate and correct time logs detailing their work schedules. A log may or may not have true information, but if it appears that the driver was falsely reporting hours of service, it can be established through requested black box data from the truck or through other more traditional forms of investigation.
